Pulse Staffing Australia Pty Ltd (ABN 35 088 197 237), located at Level 5, 50 Carrington Street, Sydney, NSW 2000, is part of the Acacium Group and trades as Pulse and Pulse Childcare Crew (“we”, “us” or “our”). We provide recruitment and workforce solutions.

We are committed to handling your personal information responsibly. We collect your personal information to deliver our services, communicate with you, and to comply with our obligations under the Privacy Act 1988 (Cth) and the Australian Privacy Principles as amended from time to time (Privacy Laws”).

COLLECTION, USE AND DISCLOSURE OF PERSONAL INFORMATION

We collect and utilise your personal information when you use or access our services or platforms, and on an ongoing basis while you remain engaged with us. We may also obtain personal information from authorised third parties such as referees, previous employers, professional registration bodies, and educational institutions, where relevant to assessing your suitability for a role.

The types of personal information we may collect include:

  • Identity details - such as your name and contact details (including your home address, email address, and mobile number).
  • Personal and professional background information– including your age, gender, occupation, employment history, remuneration, driving licences, qualifications, and references. In certain situations, we may request evidence (such as evidence of your insurance where applicable and marriage certificate to confirm a name change) to help ensure the accuracy of the information we hold.
  • Financial and compliance information – including your superannuation details, tax file number and bank account information and insurance details which we use to meet our legal obligations, process payments, and manage payroll and related compliance requirements.

We collect and utilise your personal information to:

  • Assess your suitability for employment and work placements;
  • Comply with legal and regulatory obligations, such as providing statutory references, verifying your right to work and visa conditions;
  • Procure and coordinate non-mandatory medical tests (such as drug tests) where required for a particular assignment;
  • Verify qualifications, experience, and references, including through third-party verifications;
  • Manage insurance claims, complaints, investigations, and workplace rehabilitation;
  • Manage payroll, superannuation contributions, taxation matters, and other administrative purposes;
  • Book travel arrangements such as flights and accommodation on your behalf;
  • Facilitate training and professional development, including enrolling you in mandatory compliance or learning management systems using your name and email;
  • Conduct internal operations and quality assurance, which may involve reviewing personal information during internal audits and using de-identified data for reporting purposes;
  • Conduct surveys or research questionnaires to help improve our content or our services to you; and/or
  • Maintain communication with you regarding employment matters or for marketing purposes.

Your personal information may be disclosed to:

  • Potential and actual employers and clients;
  • Acacium Group entities (including Sanctuary Recruitment Pty Ltd, Sanctuary Contract Recruitment Pty Ltd, Sanctuary Contract Recruitment Melbourne Pty Ltd and Sanctuary Contract Recruitment Queensland Pty Ltd) and members of our group in other countries as updated from time to time. This includes our parent company and its affiliated entities to facilitate legitimate business operations and meet regulatory requirements, including compliance with reporting obligations such as gender pay gap reporting;
  • Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets.
  • Next of kin or legal representatives (if necessary);
  • Contractors and suppliers (including IT service providers and hosting companies, some located overseas);
  • Finance including credit control and for payroll activity;
  • Insurance brokers and providers when necessary to handle or process an insurance claim;
  • Professional associations, workers’ compensation bodies, and law enforcement or regulatory agencies as required by law; and/or
  • Marketing agencies and event registration services to facilitate events, communications, and marketing activities.

COLLECTION, USE AND DISCLOSURE OF SENSITIVE INFORMATION

We may collect, use, and disclose sensitive information about you in accordance with the Privacy Laws. Unless otherwise specified, this information is collected directly from you.

Sensitive information we may collect includes, but is not limited to:

  • Medical information – including medical records such as health and medical histories, and information about injuries sustained while on-site. If your ongoing engagement poses a potential risk to health or safety, we may collect relevant health information in accordance with the Privacy Laws.
  • Criminal history we may collect information about your criminal record, where required by law, or necessary for roles involving healthcare, aged care, or work with vulnerable people. This may include national police checks or state-based screening requirements.
  • HR and compliance-related information – this may include records of incidents, complaints or grievances, diversity, and inclusion disclosures (including ethnicity) and any other information classified as sensitive under the Privacy Laws.

We handle sensitive information with the utmost care and confidentiality and will only be collected and used:

  • Where you have expressly consented to the disclosure, or the consent may be reasonably inferred from the circumstances;
  • Where we are required or authorised by law to do so; or
  • Where we are otherwise permitted to disclose the information under the Privacy Laws.

Sensitive Information will only be disclosed to recipients where necessary and appropriate, including:

  • Our clients who you are, or may be, assigned to work with;
  • Our suppliers that handle our payroll, IT systems, and other operational services;
  • Other entities within the Acacium Group;
  • Governmental or statutory authorities requiring information for compliance and reporting purposes; or
  • Insurers involved in managing claims and coverage.

We will only make such disclosures where required for legitimate business, legal, or compliance purposes, and always in accordance with the applicable Privacy Laws.

LEGAL AND REGLATORY REQUIREMENTS

In some circumstances, we are legally required to collect, use, or disclose your personal and sensitive information. These obligations arise under a range of Commonwealth and state legislation related to taxation, immigration, employment agency regulations, national security, professional registration, and the protection of vulnerable groups. We are required to comply with these laws when conducting background checks, verifying your right to work, and engaging you for placements in regulated settings, such as hospitals, aged care, or disability support services. Where your information is collected or disclosed to comply with legal obligations, we will do so in accordance with applicable privacy and data protection principles.

 

CONSEQUENCES OF NOT PROVIDING INFORMATION

If you do not provide the personal information we request, we may be unable to:

  • Assess your suitability for employment or work placements;
  • Identify or match you to suitable job opportunities;
  • Represent you in your job search or onboarding process; or
  • Meet our legal or compliance obligations.

Providing incomplete or inaccurate information may delay or affect the services we are able to offer you.

OVERSEAS DATA TRANSFERS

Acacium Group operates in several countries. Your personal information (including sensitive information) may be transferred to, stored, or processed in locations outside Australia (including in the United Kingdom, India, South Africa, and the Philippines).

To ensure that your Personal Information is protected, we require all overseas third parties with whom we share data to implement and maintain appropriate safeguards. These safeguards are designed to ensure your information is handled in compliance with applicable data protection laws and in a way that respects your privacy.

However, you acknowledge that where we transfer this personal information overseas, there is an increased level of risk to the security of your personal information. Where such recipients are located overseas, you may have rights to enforce such parties' compliance with applicable data protection laws, but you may not have recourse against those parties under the Privacy Laws in relation to how those parties treat your personal information.

If you do not want us to disclose your information to recipients outside of your country, please do not provide your consent as detailed in this Notice.

WEBSITE AND PLATFORM DATA

We use cookies, Google Analytics, and similar technologies to collect information about your interaction with our website, digital platforms, and electronic communications. This helps us improve user experience, security, functionality, and service delivery.

We do not collect information via these tools that directly identifies you. We collect information about your use of our websites and platforms, including your IP address, browser type, and similar data from website visits. We also obtain anonymised demographic data, such as age, location, and gender, but we cannot associate this data with specific individuals.

We use this information to help us understand which pages are viewed and other behaviours across our website, such as job application activity. MARKETING COMMUNICATIONS

We may send you marketing information and promotional communications via email, telephone, SMS, direct mail, or social media.  These may include newsletters and information related to our services.

You may opt out of marketing communications at any time by emailing dpo@acaciumgroup.com and your request will be processed within 30 days or by clicking “unsubscribe” in any email.

Please note that essential job-related communications will continue.

DATA SECURITY:

We implement physical, technical, and administrative measures to protect your personal and sensitive information. These include encryption, access controls, and cybersecurity protocols. To ensure ongoing compliance and the security of our systems and your data, we conduct regular security audits and assessments of our data protection measures.

If a data breach occurs that meets the criteria under the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth), we will notify affected individuals and report the breach to the Office of the Australian Information Commissioner (“OAIC”), as required.

HOW LONG WE KEEP YOU INFORMATION

We retain your personal and sensitive Information for as long as necessary to fulfil our regulatory, contractual, and legal obligations. When the information is no longer required, it will be securely deleted or anonymised in accordance with applicable laws and our data retention policies.

YOUR PRIVACY RIGHTS

You have the right to access and correct the personal information we hold about you.

HOW TO MAKE A PRIVACY COMPLAINT

If you are not satisfied with our response to a privacy concern, please contact our internal privacy team at dpo@acaciumgroup.com.

We will acknowledge your complaint within 5 working days and aim to provide a substantive response within approximately 28 working days.

If you remain dissatisfied, you may lodge a complaint with the OAIC at www.oaic.gov.au. We would appreciate the opportunity to address your concerns directly before you escalate the matter externally.
